Producers of Katie Holmes's Broadway play Dead Accounts, a dark family comedy by Theresa Rebeck, have announced that the show will be closing nearly two months early, wrapping up on January 6 instead of the planned February 24. Obviously the press release about the matter doesn't mention any reasons, but we can assume the show is closing because of poor ticket sales. January is a notoriously difficult frozen tundra for many a Broadway show to traverse, and Dead Accounts just didn't have it. So the cast is being spared the agony of trying. ...

TEXT-S&P cuts Consolidated Minerals to 'B-'; outlook negative

Rationale

The downgrade reflects our view that protracted softness in the manganese

market will continue to pressure ConsMin's EBITDA in the fourth quarter of

2012 and in 2013. We therefore expect that the group's leverage will be high,

with a Standard & Poor's ratio of adjusted debt to EBITDA at more than 10x at

year-end 2012, compared with 3.5x at the end of 2011. We also factor in the

prevailing uncertainty on the supply-demand balance and price for manganese in

2013, which we think may prevent ConsMin from improving EBITDA and lead to

continued negative free operating cash flow (FOCF). The downgrade also takes

into account our view, under our criteria, of the group's "less than adequate"

liquidity, which we think could weaken further if FOCF turns substantially

negative.

Lower Chinese imports of manganese pulled down ConsMin's sales volumes by 18%

in the first nine months of 2012, with a particularly severe contraction in

the Electrolytic Manganese Metal (EMM) end market. We expect very weak

fourth-quarter results, given the lower benchmark manganese price of $5.2/dmtu

(dry metric ton unit) during the period (versus $5.35/dmtu in the third

quarter), and the group's decision to temporarily halt production in Ghana in

November and December in order to focus on waste stripping amid feeble demand

from the EMM market.

We think that the group will post weak EBITDA of about $32 million for

full-year 2012 (excluding a noncash inventory write-back of about $34

million), assuming that fourth-quarter EBITDA is close to breakeven. Its cash

balances at the end of 2012 will likely decrease to about $80 million from

$133 million reported on Sept. 30, 2012.

In our base-case scenario for 2013 we factor in EBITDA of about $90 million

and debt to EBITDA below 5x for ConsMin. This is based on the following

assumptions:

-- A benchmark manganese price of $5.2/dmtu as we don't expect markedly

stronger demand for manganese ore in 2013 given the weak steel industry

conditions globally.

-- Further reductions of cash costs, which in our view will likely be the

main boost to ConsMin's EBITDA. This year, the group successfully completed

the transition from contractor mining to owner-operated mining in Australia,

thereby lowering its cash costs to $2.93/dmtu in the third quarter of 2012

from $3.63/dmtu in the same period in 2011. ConsMin should be able to achieve

additional cash cost cuts by switching to lower strip ratio pits in Australia

for the next 2-3 years.

We also take into account what we view as considerable downside risks to our

forecast, such as:

-- The lower manganese price, and

-- The group's inability to execute the cash reduction program, although

we note its good track record in 2012, and

-- Potential Australian dollar appreciation.

If 2013 EBITDA is markedly below our base case of $90 million, this would

likely lead to substantially negative FOCF and consequently weaker liquidity.

Liquidity

We assess ConsMin's liquidity as "less than adequate" under our criteria. We

think that ConsMin has limited relationships with commercial banks, as

demonstrated by the absence of sizable and long term committed liquidity

facilities. We also think that the group has limited ability to absorb a

high-impact, low probability event without need for refinancing. We also think

that material negative FOCF could tighten liquidity.

We estimate ConsMin's ratio of liquidity sources to uses at more than 1x for

the 12 months starting Oct. 1, 2012.

Key liquidity sources over this period include:

Surplus cash of about $87 million, after deduction of $30 million that we view

as tied to operations and $16 million of pledged cash.

Funds from operations of about $40 million.

$11 million under equipment-financing facility in Australia.

We project the following uses over the same period:

Capital spending of $60 million. We note that the group has the flexibility to

cut its capex if market conditions deteriorate.

No dividends and no substantial debt maturities in the next two years.

ConsMin has $22 million available under the overdraft facility in Ghana that

matures on Dec. 31, 2013. We exclude it from the liquidity sources because of

its relatively short-term maturity and the need for the group to renew it each

year.

Additional liquidity sources could stem from ConsMin's ability to divest its

minority stakes in two Australian listed mining companies, OM Holdings Ltd.

(not rated) and BC Iron Ltd. (not rated). The market value of these stakes was

$86.2 million on Sept. 30, 2012.

On the positive side, ConsMin no longer has any maintenance financial

covenants since it repaid its Australian working capital facility. The bond

documentation contains incurrence covenants: a fixed charge coverage ratio of

at least 2.5x and senior secured leverage below 2.5x. We expect these levels

were exceeded as of end-September 2012.

Still, we think that the permitted debt basket leaves substantial leeway for

additional funding.

Recovery analysis

The issue rating on ConsMin's $405 million senior secured notes due 2016

(which includes the $34 million spent on buying back outstanding notes held as

Treasury stock as of Sept. 30, 2012) is 'B-', in line with the corporate

credit rating on the company. The recovery rating on the notes is '4',

indicating our expectation of average (30%-50%) recovery in the event of a

payment default.

The recovery rating on the notes reflects ConsMin's tangible asset value and

the guarantees and security provided for the notes. At the same time, recovery

prospects are constrained by material, senior claims with a legal or

structural advantage, which are attached to some of the company's valuable

Australian assets. Weaker enforceability prospects in the more uncertain

Ghanaian jurisdiction further constrain recovery prospects.

The notes are guaranteed by subsidiaries representing 86% of consolidated

total assets at end-December 2011 and benefit from the following:

A first-ranking lien over all of the shares in the issuer and the guarantors

that are located outside of Australia.

A first-ranking lien equitable mortgage over all of the shares in the

Australia-based guarantors, and a first-ranking lien over substantially all of

their property and assets (excluding the priority security).

A second-ranking charge over inventory and stockpiles of ore held by the

Australian guarantors, as well as over accounts receivable from the sales of

such ore (the "priority security"). However, at enforcement, the notes will

rank second in right of payment behind the credit facilities in respect of the

proceeds of the Australian security package.

We believe that the most likely center of main interest will be Jersey (U.K.)

or Australia, where the most valuable security is located and where we believe

there are creditor-friendly insolvency regimes. However, we note that the

company generates a substantial part of its earnings in Ghana (B/Stable/B), a

country with a degree of sovereign risk and whose insolvency regime and

jurisdiction we have not analyzed.

Our simulated default scenario contemplates a default in 2014, mainly owing to

volatility in the manganese mining industry, combined with ConsMin's potential

inability to service its debt.

We value the company as a going concern. This is because we believe it would

most likely be reorganized in the event of a hypothetical default, given its

good position in the manganese market. We calculate ConsMin's EBITDA at about

$60 million at the time of simulated default. Assuming a 4.5x multiple of

EBITDA at default--to account for the volatility of valuations in the sector

and the location of assets--we obtain a gross enterprise value of about $270

million.

After deducting priority liabilities, drawings under the $20 million

equipment-financing facility, and permitted debt under the covenants, we

calculate that about $165 million would be available for noteholders. Of

these, we estimate that about 70% would come from Australia, the most reliable

jurisdiction in insolvency situations (in spite of the current

underperformance) and the provider of tangible asset security to the notes,

although there could be upside coming from the asset security provided in

Ghana, as the company has generated and will likely generate a significant

portion of its EBITDA there. In addition, our valuation includes six months of

prepetition interest. We therefore anticipate average (30%-50%) recovery

prospects for the $405 million notes, which equates to a recovery rating of

'4'.

Outlook

The negative outlook reflects the risk of a downgrade in the next 12 months if

we saw a substantial reduction in ConsMin's cash balance and ensuing

deterioration in its liquidity. This could stem from sizable negative FOCF in

2013, which could in turn be triggered by EBITDA below the $90 million we

anticipate in our base case, owing to further manganese price declines, or

delays in the group's cost reduction plan, and the absence of timely capex

adjustments.

We could revise the outlook to stable if ConsMin successfully executed its

program to cut cash costs, and returned to sustainable neutral-to-positive

FOCF based on manganese prices steadily above $5/dmtu.

New computer bridges classical and quantum computing

A new type of machine could rival quantum computers in exceeding the power of classical computers, researchers say.

Quantum computers rely on the bizarre properties of atoms and the other construction blocks of the universe. The world is a fuzzy place at its very smallest levels ? in this realm where quantum physics dominates, things can seemingly exist in two places at once or spin in opposite directions at the same time.

The new computers rely on "boson" particles, and resemble quantum computers, which differ from traditional computers in important ways. Normal computers represent data as ones and zeroes, binary digits known as bits that are expressed by flicking switch-like transistors on or off. Quantum computers, however, use quantum bits, or qubits (pronouced "cue-bits"), that can be on and off at the same time, a state known as "superposition."

This allows the machines to carry out two calculations simultaneously. Quantum physics permits such behavior because it allows for particles that can exist in two places at once or spin in opposite directions at the same time.

[Experiment Demonstrates Possibility of Quantum Internet]

In principle, quantum computers could solve certain problems much faster than can classical computers, because the quantum machines could run through every possible combination at once. A quantum computer with 300 qubits could run more calculations in an instant than there are atoms in the universe.

However, keeping qubits in superposition is challenging, and the problem grows more difficult as more qubits are involved. As such, building quantum computers that are more powerful than classical computers has proven very difficult.

Now, though, two independent teams of scientists have built a novel kind of device known as a boson-sampling computer. Described as a bridge between classical and quantum computers, these machines also make use of the bizarre nature of quantum physics. Although boson-sampling computers theoretically offer less power than quantum computers are capable of producing, the machines should still, in principle, out-perform classical computers in certain problems.

In addition, a boson-sampling computer does not require qubits. As such, "it's technologically far simpler to create than building a full-scale quantum computer," said researcher Matthew Broome, a quantum physicist at the University of Queensland in Australia.

Boson-sampling computers are actually a specialized kind of quantum computer (which is known more formally as a universal quantum computer).

"The main difference between boson-sampling computers and universal quantum computers is that boson-sampling quantum computers can't solve a universal set of problems like universal quantum computers can," Broome said. "But they are still conjectured to be able to solve problems that would be massively intractable for classical computers. Boson sampling computers are an intermediate model of a quantum computer."

Boson-sampling computers are not based on qubits, but on particles called bosons. "In our case, we use photons," said researcher Ian Walmsley, a quantum physicist at the University of Oxford in England. Photons are the packets of energy that make up light, and are one type of boson.

Broome and Walmsley were in separate groups that each devised a boson-sampling computer, based off concepts first described by theoretical computer scientist Scott Aaronson at MIT. The computers involve multiple devices that can each generate single photons. The photons are inserted into a network where they can interact with one another. They emerge from outputs equipped with sensors to analyze the particles.

The task of calculating which outputs these photons will emerge from, an operation known as boson sampling, grows well beyond the capabilities of classical computers the more photons are involved. The new computers accurately resolved what paths the photons would take ? three photons with Broome and his colleagues' machine and four in Walmsley and his collaborators' device.

Since boson-sampling computing is in its infancy, it remains uncertain whether these computers can solve problems beyond boson sampling. Still, this research suggests that computers based on quantum physics could indeed tackle problems beyond the reach of classical computers.

Previously, there was nothing to say "that anything you can do on a quantum computer you can't do on a normal computer, which leaves in question the necessity for quantum computers," Broome said. "Now, with boson sampling, we're coming up with machines based on quantum physics that can attack problems strongly believed to be intractable for classical computers."

In the future, "it would be great to push these computers toward more photons to tackle problems that would be challenging to simulate on normal computers," study coauthor Walmsley added. Using about 20 to 30 photons would be a problem?beyond the capabilities of classical computers.

Both research teams detailed their findings online Dec. 20 in the journal Science.

Amanda Reyes, Former Toy Store Manager, Claims Ex-Boss Coerced 'Rough' Sexual Relationship, Sues

A former manager of a New York City children's toy store is suing her ex-boss over what she says was a coercive sexual relationship, according to the New York Daily News.

Amanda Reyes, 26, alleges that Steven Reis, 60, the owner of Fantastic Kids Toys, forced her to "engage in an ongoing sexual relationship? that ?included increasing acts of ?rough? sexual activities, including hitting, slapping and biting,? in exchange for employment and rent, according to the lawsuit filed Friday.

Reyes, a single mother, started working at the store for $10 an hour in 2010 and was promoted to manager in March 2012. According to the lawsuit, this is when Reyes' relationship with the married Reis began.

Gothamist called the affair a "sadomasochistic nightmare," noting that Reyes' attorneys described it as a "manipulative master-servant type of relationship" that involved "role-playing and simulations."

Even after Reyes began dating an NYPD officer in June, Reis allegedly demanded the woman meet him at her apartment for sex twice a week.

As Jezebel points out, Reyes reportedly tried to break off the relationship and was fired from her $60,000-a-year job in late August.

Reis, reached at his Manhattan store by the New York Post on Dec. 24, would not comment on the lawsuit other than to call the accusations "false."

Of course, this is not the first time an employer has come under fire.

In November, the CEO of Waffle House was sued by a former employee, a single mother who alleged that she was forced to perform sex acts for 10 years in order to keep her job, according to the Associated Press.

The CEO, Joe W. Rogers Jr., claimed the charges were "extortion," but the woman accusing him allegedly taped some of their encounters.

Muslim scholars and clerics: suicide bombings are un-Islamic.

Suicide bombers in Afghanistan have shown little restraint: Wedding parties and even mosques and children have witnessed gruesome targeting by the Taliban against civilians.

But as attacks soared in the summer and fall, killing scores of civilians every week ? including at least 40 Muslim devotees at a mosque in late October ?public revulsion has turned into unprecedented condemnation.

For the first time in late January, Muslim scholars and clerics from around the world will come to Kabul specifically to condemn suicide bombings as un-Islamic. The conference will be the first to focus on suicide bombing, and its framers hope the result will reverberate beyond Afghanistan.

"Many times, scholars in Pakistan and Afghanistan have made statements but had no influence," says Mufti Shamsur Rahman Firotan, a religious scholar in Kabul. "This one will have influence, and will give the idea to the people that suicide attacks are forbidden. The message is for all: in Iraq, in Pakistan, all these [militant jihadist] groups."

Senior United Nations officials have challenged religious officials to speak more loudly against attacks carried out in the name of Islam, while Afghan religious scholars have long decried suicide attacks, with little response by the ultra-conservative Taliban. An official gathering this summer resolved that suicide attacks "have no legitimate foundation in Islam."

It had little effect at the time. But those declarations have now been further bolstered. Saudi Arabia?s Grand Mufti, the highest religious authority in the birthplace of Islam and respected by the Taliban, explicitly condemned suicide bombing.

Yet since Sheikh Abdulaziz bin Abdullah Al al-Sheikh issued such a high-profile public statement in late October, Taliban suicide attacks have continued, some with multiple bombers. But Afghan religious scholars say momentum is building against them.

One reason is because Mr. Abdulaziz ?does have influence on the Taliban," says Mr. Firotan, who is a member of Afghanistan's Ulema Council of Islamic scholars, which has long campaigned against civilian deaths.

"The Taliban think we are their enemies, so they don't respect our declarations," says Mr. Firotan. "But Mufti Aziz is respected by them, and all around the Islamic world?. It has influence."

INVOKING MUHAMMED

The newsletter of Afghanistan?s religious scholars, called Al-Islam, publicized the Grand Mufti?s high-profile pronouncement against suicide bombing.

Invoking the Muslim prophet Mohammed, Abdulaziz noted that killing innocents has been forbidden for 14 centuries. He said justifying suicide attacks in the name of religion was a "misuse" of Islam.

"Attacks, suicide attacks, and killing of the innocent have no place in Islam, and whoever conducts these are not just deprived of Paradise, but they will go to hell," Abdulaziz said according to Al-Islam. "There is jihad in Islam, but it is very different from killing of the innocent and suicide attacks [which does] not benefit the people and humanity."

The Taliban claims it has not "officially" received Abdulaziz's fatwa (or religious decree), says Firotan, but only heard about it.

'THIS IS NOT THE WAY'

The Quran makes clear that self-defense is acceptable, says Firotan, providing "there is no other way to live, but that is not the situation now."

For those who want to fight US forces, says Firotan, there are methods. "But this is not the way ? to go to mosques, banks, bazaars, or shops. There, are 100 percent, some Taliban who are [also] against these actions."

As the Taliban has waged its insurgency in recent years, it has also increasingly targeted civilians, along with US and NATO military forces, Afghan security, and the government. By early summer, the toll caught the attention of the UN Special Representative Jan Kubis, who lamented in a speech that every morning started with ?very sad news? of civilian deaths.

Addressing an Islamic cooperation conference in June, he said the previous ?typical? week had 200 civilian casualties, with 57 dead. The week before registered 244 casualties, with 90 killed. One day saw three suicide bombings; another single day left 107 casualties.

Such a soaring toll was "unacceptable," Kubis said. "We keep hearing reports of suicide bombings, intimidation, targeted killings, assassination of elders, religious leaders, teachers, and scholars, burning of schools ? all done in the name of Islam."

Yet Kubis noted that different interpretations are also heard, based on the Quran, that show such acts to be un-Islamic. The result has been confusion and questions in the minds of many Afghans.

"They are not anymore sure what is the truth, what is right, what is wrong, what is Islamic, what is non-Islamic," said Kubis. He challenged the religious scholars to magnify their voices: "You have a major role, a major responsibility to help."

That message has been transmitted many times by many religious scholars and officials, over many years. But it has yet to break through to those who favor such attacks, as ?religious? as their ideology is meant to be.

EASIER SAID, THAN DONE

Even the writ of Taliban chiefs is limited, as shown by the example of fugitive leader Mullah Omar. In 1998 he condemned the use of anti-personnel landmines as "un-Islamic" and "anti-human."

Despite that, the UN Assistance Mission in Afghanistan (UNAMA) notes that improvised explosive devices (IEDs) placed by Taliban operatives are "by far the biggest killer of civilians" in Afghanistan. In the first nine months of this year, they caused 340 deaths ? a nearly 30 percent increase from the same period the previous year.

Likewise, suicide attacks remain a pernicious killer, despite the volume of religious scholarship against it.

"Practically every family has suffered some form of attack by these suicide bombings or IEDs, and they don't look at it very kindly," says Massoumeh Torfeh, the director of strategic communications for UNAMA in Kabul.

Abdul Hakim Mujahid, a former Taliban ambassador to the UN who is now a member of the High Peace Council, tasked by the government of President Hamid Karzai with talking to the Taliban, says the opinions of religious figures can have an impact.

"Afghanistan is a religious country, and absolutely the majority are listening to their religious scholars," says Mr. Mujahid. About the Taliban, he says: "They are human beings, and also they have their religious scholars."

Mujahid quotes the Quran, saying: "You have to fight against those who are fighting against you. But do not cross the limit."

That limit is beyond "proportional reaction," says Mujahid: "It means that when someone is fighting against you with their fists, you should not use a Kalashnikov."

The Taliban see themselves as "being attacked, that war is being waged against [them]," adds Mujahid. The High Peace Council is "trying our best to convince them that war is not to the benefit of any party [and to] settle everything by negotiations, not by fighting."

Tigers have delivered a bit of holiday cheer: populations are on the upswing, it turns out, in some protected areas in India and Thailand. In a field often dominated by news of felled forests and population declines, wildlife conservationists have taken heart from this development, while noting that tigers have a long, long way to go if they are to claw their way off the endangered species list.

?If the conditions are right, tiger populations can recover, though there?s still plenty of challenges,? said Cristi?n Samper, the president and chief executive of the Wildlife Conservation Society. ?I think the encouraging news is that we now know it can work.?

At the start of the 20th century, tigers numbered around 100,000 and occupied forests from Turkey to Russia to Indonesia. Today around 3,200 wild tigers occupy just 6 percent of their historic range as a result of habitat destruction, retaliatory killings and poaching for the illegal wildlife trade. ?We?ve reached a point where tigers are so much in danger of being lost that we suddenly value them and realize how important it is to hold on to them,? said John Robinson, the Wildlife Conservation Society?s chief conservation officer.

The Wildlife Conservation Society first homed in on the tiger problem in the 1960s, starting with India. Thanks in part to a strong commitment from the Indian government, tigers in the Western Ghats region of Karnataka State have quadrupled in number over the past 30 years, with more than 600 of the large cats currently living in the area.

The organization monitors the tigers with camera traps, using unique stripe patterns to identify individual animals and monitoring the abundance of tiger prey as well. (Prior to the advent of camera traps, researchers estimated tiger numbers by counting their tracks). The government provides support for keeping poachers at bay and managing conflicts with humans.

?The underlying factor in the few successes we?ve seen is when the government takes a real interest,? said Alan Rabinowitz, chief executive of the conservation organization Panthera, one of the Wildlife Conservation Society?s collaborative partners. ?An N.G.O. along can?t accomplish this alone ? the government really has to step up and put in its own law enforcement resources.?

With lessons from the Western Ghats in hand, the conservation organization began expanding its tiger program to include India?s Nagarahole and Bandipur National Parks, which have since seen around 50 percent increases in tiger populations. Conservationists also set up shop in Thailand?s Huai Kha Kaeng wildlife sanctuary, where tiger poaching had reached epidemic proportions as a result of black market demand for the animals? bones, reproductive organs, pelts and meat.

The Thai government bolstered enforcement and anti-poaching patrols as the scientists outfitted the area with camera traps. Last February, those traps proved useful not just for monitoring tiger populations but also for providing evidence in court that tiger poachers took their illegal prey from the sanctuary. Today, around 50 tigers roam that forest.

But not all tigers can be saved. In Vietnam and Cambodia, for example, conservationists have largely written tigers off as a lost cause; tiger numbers in Myanmar and Laos are steadily decreasing.

Rather than trying to protect every remaining individual tiger from the varied problems that threaten to wipe out the species, the Wildlife Conservation Society decided to focus on so-called ?source sites,? or areas where at least 25 breeding females live. So far, the organization has identified 42 such sites in India, Laos, Myanmar, Thailand, Russia and northern China, and it is working in 24 of them. ?These are areas where we have a realistic chance of protecting tigers,? Dr. Robinson said. ?This enables us to focus our attention.?

To undertake protective measures in all 42 sites would require an investment of around $95 million annually. Half of that money is in place as a result of governmental support and fund-raising by nongovernmental organizations, but funds are lacking for further expansion. ?Basically, we need to ramp up our financial support for law enforcement, tiger monitoring and addressing wildlife trade issues within countries,? Dr. Robinson said. ?If we could put those pieces in place, we could turn things around for tigers.?

For now, however, conservationists are celebrating the small victories.

?Things are not good in the tiger world, but they?re better than they were,? Dr. Rabinowitz said. ?Some tigers are going to blink out, but there?s still a lot of hope for saving them in some really wild areas.?

Pope Christmas Eve Mass 2012: Find Room For God

VATICAN CITY, Dec 24 (Reuters) - Pope Benedict, leading the world's Roman Catholics into Christmas, on Monday urged people to find room for God in their fast-paced lives filled with the latest technological gadgets.

The 85-year-old pope, marking the eighth Christmas season of his pontificate, celebrated a solemn Christmas Eve mass in St Peter's Basilica, during which he appealed for a solution to the Arab-Israeli conflict and an end to the civil war in Syria.

At the mass for some 10,000 people in the basilica and broadcast to millions of others on television, the pope wove his homily around the theme of God's place in today's modern world.

"Do we have time and space for him? Do we not actually turn away God himself? We begin to do so when we have no time for him," said the pope, wearing gold and white vestments.

"The faster we can move, the more efficient our time-saving appliances become, the less time we have. And God? The question of God never seems urgent. Our time is already completely full," he said.

The leader of the world's some 1.2 billion Roman Catholics said societies had reached the point where many people's thinking processes did not leave any room even for the existence of God.

"Even if he seems to knock at the door of our thinking, he has to be explained away. If thinking is to be taken seriously, it must be structured in such a way that the 'God hypothesis' becomes superfluous," he said.

"There is no room for him. Not even in our feelings and desires is there any room for him. We want ourselves. We want what we can seize hold of, we want happiness that is within our reach, we want our plans and purposes to succeed. We are so 'full' of ourselves that there is no room left for God."

PEACE CANDLE

Bells inside and outside the basilica chimed when the pope said "Glory to God in the Highest," the words the gospels say the angels sang at the moment of Jesus' birth.

Earlier on Monday the pope appeared at the window of his apartments in the apostolic palace and lit a peace candle, as a larger-than-life nativity scene was unveiled in St Peter's Square below.

Reflecting on the gospel account of Jesus born in a stable because there was no room for Mary and Joseph in the inn, he said when people find no room for God in their lives, they will soon find no room for others.

"Let us ask the Lord that we may become vigilant for his presence, that we may hear how softly yet insistently he knocks at the door of our being and willing.

"Let us ask that we may make room for him within ourselves, that we may recognise him also in those through whom he speaks to us: children, the suffering, the abandoned, those who are excluded and the poor of this world," he said.

He asked for prayers for the people who "live and suffer" in the Holy Land today.

The pope called for peace among Israelis and Palestinians and for the people of Syria, Lebanon and Iraq and prayed that "Christians in those lands where our faith was born may be able to continue living there, that Christians and Muslims may build up their countries side-by-side in God's peace."

The Vatican is concerned about the exodus from the Middle East of Christians, many of whom leave because they fear for their safety. Christians now comprise five percent of the population of the region, down from 20 percent a century ago.

According to some estimates, the current population of 12 million Christians in the Middle East could halve by 2020 if security and birth rates continue to decline.

Ledbetter law doesn't apply to state pay claims ? Business ...

Under the federal Lilly Ledbetter Fair Pay Act of 2009, employees who believe their paychecks reflect a discriminatory pay decision made years or even decades ago can still sue. The legal rationale: That each subsequent paycheck was theoretically lower than it should have been and each pay period amounts to a new violation.

However, that principle doesn?t apply if an employee pursues a state pay discrimination claim under the Texas Commission on Human Rights Act. Instead, employees have to file a complaint within 180 days of the discriminatory pay decision, not from the date of the last paycheck.

Recent case: Diljit, a woman of Indian national origin, is a professor at Prairie View A&M University. She began working for the university in 1987 and applied for a promotion from associate professor to full professor in 2003. Initially denied, she reapplied the following year and was promoted. However, she thought her salary was too low because of discrimination. The university refused to raise Diljit?s pay, citing budget constraints.

Diljit did nothing for several years, but finally filed complaints with the EEOC and the Texas Workforce Commission. She claimed a continuing violation and said her paychecks reflected discrimination every payday.

The case ended up in the Texas Supreme Court. The university argued that Diljit should have filed her complaint within 180 days of the promotion.

The court agreed. It said that while the U.S. Congress made an exception for late pay discrimination claims by enacting the Ledbetter Act, the Texas Legislature didn?t follow suit. Therefore, state pay discrimination claims must commence within 180 days of the original alleged discriminatory act. (Prairie View A&M University v. It?s good to end the working week with a bit of gaming fun so I was glad to find out about a new car racing game called Pyongyang Racer. This is the first game I?ve seen from North Korea and it?s ?fully playable? online. Appropriately for communist creative output it?s not a demo of a commercial version of the game and doesn?t integrate any F2P shenanigans. However there aren?t that many other good points to the game.

Pyongyang Racer is the creation of game developer Nosotek and was commissioned by Koryo Group, a British travel agency that specialises in taking people to North Korea. If this was a publicity stunt by the travel agency it?s not doing them any favours, at the time of writing, because the web site is down ?taking too long to respond?. This is possibly due to unprecedented bandwidth demands; last night before I could ?enjoy? a drive around virtual Pyongyang the game took taking ages to load...

The game is simple and the car handles as you would expect from its basic appearance. Cursor keys control your accelerator, brakes and steering and the spacebar beeps the horn. The rules are ?Collect petrol barrels to keep your car full of fuel. If you don?t you will run out of petrol and the game ends?. To collect the fuel you run over the petrol barrels. Other than that the streets are very empty. ?

Kotaku describes the game as similar in appearance to something contemporary to the Sega Saturn but that?s being generous. However the Kotaku writer had more stamina than I because he completed the course using about 12 minutes of his life. I never finished the ?race? because I was interested in driving off the main roads to have a look around the back streets ? a police lady stubbornly refused me going off the pre-planned route.

Russia says it won't host Assad but others welcome

MOSCOW (AP) ? Russia's foreign minister says Moscow would welcome any country's offer of a safe haven to Syrian President Bashar Assad, but underlined that Moscow itself has no intention of giving him shelter if he steps down.

Russia has repeatedly used its veto right along with China at the U.N. Security Council to protect its old ally from international sanctions, but it has increasingly sought to distance itself from Assad.

Foreign Minister Sergei Lavrov told reporters late Friday that countries in the region he wouldn't name publicly had asked Russia to convey their offer of a safe passage to Assad. He said that Russia responded by telling them to go directly to Assad: "We replied: 'What do we have to do with it? If you have such plans, you go straight to him.'"

Asked if Moscow could offer a refuge to Assad, Lavrov responded that "Russia has publicly said that it doesn't invite President Assad."

"If there is anyone willing to provide him guarantees, they are welcome!" Lavrov told reporters on board a plane returning from Brussels where he attended a Russia-EU summit. "We would be the first to cross ourselves and say: "Thank God, the carnage is over! If it indeed ends the carnage, which is far from certain."

Lavrov also said the Syrian government has pulled its chemical weapons together to one or two locations from several arsenals across the country to keep them safe amid the rebel onslaught.

"According to the information we have, as well as the data of the U.S. and European special services, the government is doing everything to secure it," he said. "The Syrian government has concentrated the stockpiles in one or two centers, unlike the past when they were scattered across the country."

U.S. intelligence says the regime may be readying chemical weapons and could be desperate enough to use them. Both Israel and the U.S. have also expressed concerns they could fall into militant hands if the regime crumbles.

Lavrov gave no indication that Moscow could change its opposition to sanctions against Assad. He assailed the West for failing to persuade the opposition to sit down for peace talks with the government, saying that "the Syrian president's head is more important for them than saving human lives."

Lavrov added that U.N. peace envoy for Syria, Lakhdar Brahimi, would visit Moscow for talks before the year's end.

He said that Moscow has also invited the revamped Syrian opposition leadership to visit.

"We are ready to honestly explain that the emphasis on a military solution and the dismantling of the state institutions is disastrous for the country," he said. "Listen, there will be no winner in this war."

Texas picked up its second junior college pledge of its 2013 class in former Tennessee commit De'Vondre Campbell.

The Hutchinson (Kan.) Community College three-star outside linebacker gave his verbal pledge to Texas on the eve of junior college signing day, the school announced in a release Tuesday night.

Campbell had been committed to Tennessee since May 4, but the dismissal of Derek Dooley and his coaching staff at the end of this season led him to look elsewhere.

New, Hello!! NEED HELP FAST

Hi, my names Kookoo127. People usually call me Kookie. ASK ME SMALL QUESTIONS FAST!!!! Need to PM somebody fast. Just to fill up space I'm going to tell you about... my past RP experiences. Well, here we go: I started roleplaying on a different website a little over a year ago. It was an Invader Zim RP called Savor The Moments. There were some problems with god-modding so it got taken down, they tried to revive the RP shortly after, but it was too late. I created a new RP: .drawkcaB which was very successful. It had a minorly successful sequel and a FAILED third sequel. I'm not a beginner, but except on rare occasions, I do not post more than a paragraph or two at a time. Depending on the situation I can be: Happy, Funny, Sad, Dark, and once I even roleplayed a boy in love... who died. :) (I'm a zombie fan, so keep that in mind.)

Host cholesterol secretion likely to influence gut microbiota

Dec. 18, 2012 ? For more than half a century, researchers have known that the bacteria that colonize the gastrointestinal tract of mammals influence their host's cholesterol metabolism. Now, Jens Walter and colleagues of the University of Nebraska show that changes in cholesterol metabolism induced by diet can alter the gut flora. The research was published online ahead of print in the journal Applied and Environmental Microbiology.

In the study, the researchers added plant sterol esters to the diets of hamsters. The overall effect of this was to inhibit several bacterial taxa, from the families Coriobacteriacea and Erysipelotrichaceae, says Walter. But the immediate effect of the plant sterols was to physically block cholesterol absorption by the intestine. That decreased cholesterol levels in the liver and the plasma, prompting the hamster's body to respond by synthesizing more cholesterol. That, in turn, boosted cholesterol excretion into the gut, and that extra cholesterol was the direct inhibitor of those bacterial families.

"The abundance of these bacterial taxa and the levels of cholesterol in the fecal samples followed a mathematical model of bacterial inhibition," says Walter.

Practically speaking, the microbial inhabitants of the gut are part of the metabolic system. Researchers have shown that certain health problems are related to changes in the gut flora, such as can be induced by overuse of antibiotics. Since changes in diet can influence composition of the gut flora, health problems such as obesity might be targeted by dietary interventions designed to suppress bacteria that contribute to weight gain. "However, for these to be successful, we need to know which bacterial patterns not only are associated with disease, but actually contribute to it," says Walter, noting that his research showed that some alterations associated with metabolic disease might be the consequence, rather than the cause of the disorder.

Walter says that the work was a real student project. Among the coauthors, three were graduate students, and two were undergraduates. "As a supervisor, it is extremely nice to see young scientists work as a team, and staying dedicated through the five years that this project took to complete," he says.

Formal publication is scheduled for the January 2013 issue of Applied and Environmental Microbiology.

Cerberus: We want out of gun biz - Fortune Finance: Hedge Funds ...

FORTUNE -- Private equity firm Cerberus Capital Management announced early this morning that it plans to sell Freedom Group, a firearms conglomerate that produced the .223 Bushmaster rifle used in last week's elementary school massacre.

Here is the firm's statement, in full:

We were shocked and deeply saddened by the events that took place at the Sandy Hook Elementary School in?Newtown, CT?on?December 14, 2012.? We cannot comprehend the losses suffered by the families and friends of those killed by the unthinkable crimes committed that day.? No words or actions can lessen the enormity of this event or make a dent in the pain that was inflicted on so many.

In 2006 affiliates of Cerberus Capital Management, L.P. made a financial investment in Freedom Group.? Freedom Group does not sell weapons or ammunition directly to consumers, through gun shows or otherwise.? Sales are made only to federally licensed firearms dealers and distributors in accordance with applicable laws and regulations.? We do not believe that Freedom Group or any single company or individual can prevent senseless violence or the illegal use or procurement of firearms and ammunition.

It is apparent that the?Sandy Hook?tragedy was a watershed event that has raised the national debate on gun control to an unprecedented level. ?The debate essentially focuses on the balance between public safety and the scope of the Constitutional rights under the Second Amendment.? As a Firm, we are investors, not statesmen or policy makers.? Our role is to make investments on behalf of our clients who are comprised of the pension plans of firemen, teachers, policemen and other municipal workers and unions, endowments, and other institutions and individuals.? It is not our role to take positions, or attempt to shape or influence the gun control policy debate.? That is the job of our federal and state legislators.

There are, however, actions that we as a firm can take.? Accordingly, we have determined to immediately engage in a formal process to sell our investment in Freedom Group.? We will retain a financial advisor to design and execute a process to sell our interests in Freedom Group, and we will then return that capital to our investors.? We believe that this decision allows us to meet our obligations to the investors whose interests we are entrusted to protect without being drawn into the national debate that is more properly pursued by those with the formal charter and public responsibility to do so.

Our thoughts and prayers are with the families and communities impacted by this tragic and devastating event.

To be clear, this is not a financial decision by Cerberus.

Freedom Group's value today is artificially low, judging by the plunging stock prices of publicly-traded gun makers like Smith & Wesson (SWHC) and Sturm Ruger & Co. (RGR). Moreover, it's difficult to imagine that another private equity firm would agree to buy the company from Cerberus -- which had tried to take Freedom Group public several years back, but was stymied by weakening sales and management shakeups. My best guess is that a foreign firearms company will be the eventual buyer at a major discount.

What we still don't know if what pressure, if any, Cerberus limited partners brought to bear on the firm since last Friday. Yesterday we reported that one of the largest investors in Cerberus private equity funds was the California State Teachers' Retirement System, which subsequently said it would review its indirect investment in Freedom Group (it made no such pledge following the Aurora shooting, where a Bushmaster rifle also was used).

Truth is, however, an LP like CalSTRS really can't do much after the original fund commitment is made, save for a secondary sale of its entire fund stake (which is why I argued it should have been proactive, rather than reactive). Unless, of course, it and others helped prod Cerberus into this morning's decision -- reminding the firm that they sometimes want their fund managers to focus more on the sense than the dollars.

Update: Bloomberg is reporting that the father of Cerberus founder and CEO Stephen Feinberg is a resident of Newtown, Connecticut. No word yet on if this factored into the firm's decision-making process...
